California Legislative LGBTQ Caucus Condemns Supreme Court Shadow Docket Mirabelli Ruling

 

SACRAMENTO, CA — The California Legislative LGBTQ Caucus released the following statement in response to the Supreme Court of the United States’ shadow docket ruling in Mirabelli et al v. Bonta:

 

“The California Legislative LGBTQ Caucus strongly condemns the preliminary ruling by the conservative majority of the Supreme Court in Mirabelli that advances a sweeping, anti-LGBTQ+ change in the law.

 

For LGBTQ+ youth, forced outing is not a theoretical concern – it will result in discrimination, rejection, homelessness, and even violence. California recognizes that educators should not be transformed into agents of compulsory disclosure and that these conversations should be personal family matters that take place in a manner and at a time chosen by the family unit. By attempting to recast nondiscrimination and privacy rights as government secrecy, conservatives on the Court attempt to disguise the justifications for their own political rhetoric as legal analysis.

 

Protections exist to safeguard individuals’ safety, dignity, and equal access – not to exclude families, but to ensure that vulnerable young people are not placed at risk. Conflating this issue with secrecy ignores the real-world consequences that forced disclosure can have and mischaracterizes the role of educators in supporting student well-being.

 

While this case is still being litigated, the ruling effectively revives Judge Benitez’s prior decision, creating real fear and anxiety among LGBTQ+ students and their families. Our commitment is unwavering: California schools must remain safe, inclusive environments where every student, including LGBTQ+ youth, can learn, grow and be the truest version of themselves without fear of political interference in deeply personal family matters.”
